J&K Government Launches Land Pooling Policy 2026, Mandates 70% Consent

The Jammu and Kashmir government has officially notified its Land Pooling Policy 2026, aimed at accelerating urban development. Issued by the Housing and Urban Development Department via Government Order No. 173-JK(HUD) on August 17, 2026, the policy aims to streamline land acquisition through voluntary participation.

Under this policy, participation of landowners is essential for successful urban planning. The government mandates that at least 70% of landowners in a contiguous area must consent for land pooling to proceed effectively. The policy seeks to foster collaboration between landowners and developers, turning them into partners in the development process.

Developers interested in transforming a parcel of land must register their intent. Upon achieving the necessary landowner consent, a land pooling scheme can officially commence. This collaborative approach promises to facilitate comprehensive planning, ensuring sustainable urban growth.

A significant provision of this policy allows a Developer Entity or consortium to retain 60% of the pooled area. Meanwhile, the remaining 40% will be surrendered to the Development Authority free from encumbrances. This shared responsibility model promotes the creation of necessary infrastructure for better urban living.

The land allocated to the developers is intended for various developments, including residential, commercial, and institutional projects, alongside recreational and public amenities. This approach aligns with J&K’s Master Plan and Zonal Development Plans, facilitating a well-structured urban landscape.

The Land Pooling Policy also introduces opportunities for participating landowners to negotiate equitable forms of land distribution, whether through developed plots, built-up spaces, or other mutually beneficial arrangements.

The concerned Development Authority plays a central role in ensuring the effective application of this policy. Implementing a Single Window System, the authority will oversee approvals, develop planning proposals, and coordinate with essential services such as water supply, sewerage, and electricity to guarantee efficient execution.

On top of that, the Development Authority is tasked with establishing a transparent dispute-resolution mechanism. This ensures fair handling of grievances related to the land pooling initiatives. The policy outlines a structured grievance redressal framework comprising two stages.

The first-stage committee, led by the Designated Land Pooling Officer, aims to resolve complaints within 30 days of their submission. If necessary, individuals can appeal to a second-stage committee headed by the Vice Chairman or Chief Executive Officer of the Development Authority.

The government places strong emphasis on transparency through the proposed online portal for land pooling applications. This platform will enhance efficiency by covering all stages from application submission to project monitoring, encouraging an inclusive participatory approach.

In terms of timelines, the policy stipulates that the formation of a developer consortium must occur within 60 days, which can be extended by an additional 30 days. Furthermore, the submission of the land pooling scheme to the Development Authority must be completed within six months from the consortium’s inception. Overall, all activities under this scheme must conclude within a maximum period of five years.

The Jammu and Kashmir government stated that operational responsibilities of these pooled areas will remain with the Developer Entity or consortium until successful completion, followed by transfer of infrastructure duties to the designated Urban Local Body.

This innovative Land Pooling Policy 2026 marks a significant step towards comprehensive urban planning in Jammu and Kashmir. It not only promotes partnerships between landowners and developers but also embodies a transparent and efficient approach to land development in the region.
